Aceste actualiz\u0103ri aliniaz\u0103 legisla\u021bia muncii din Moldova la standardele Uniunii Europene \u0219i ofer\u0103 un cadru legal clar pentru angajatorii autohtoni care doresc s\u0103 angajeze lucr\u0103tori temporari.<br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><strong>Nu este o lege nou\u0103, ci o reform\u0103 esen\u021bial\u0103<\/strong><\/strong><\/h2>\n\n\n\n<p>Pentru claritate, nu este vorba despre o lege separat\u0103, ci despre un set de <strong>modific\u0103ri \u0219i complet\u0103ri la Codul muncii<\/strong>. Pentru prima dat\u0103, Moldova define\u0219te \u0219i reglementeaz\u0103:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Agen\u021bii de munc\u0103 temporar\u0103 (AMT)<\/li>\n\n\n\n<li>Lucr\u0103torii temporari<\/li>\n\n\n\n<li>Utilizatorii (angajatori) care folosesc munc\u0103 temporar\u0103 prin AMT<br><\/li>\n<\/ul>\n\n\n\n<p>Reforma este aliniat\u0103 la Directiva 2008\/104\/CE a UE \u0219i la alte directive europene privind munca \u0219i securitatea \u00een munc\u0103.<br><br><\/p>\n\n\n\n<div class=\"wp-block-buttons is-layout-flex wp-block-buttons-is-layout-flex\">\n<div class=\"wp-block-button\"><a class=\"wp-block-button__link wp-element-button\" href=\"https:\/\/ara.md\/ro\/despre-ara\/\"> Despre ARA<\/a><\/div>\n<\/div>\n\n\n\n<p><br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><strong>De ce este important \u2013 Mai ales pentru angajatorii din Moldova<\/strong><\/strong><\/h2>\n\n\n\n<p>P\u00e2n\u0103 acum, Moldova nu avea un cadru legal pentru angaj\u0103rile temporare, ceea ce limita flexibilitatea solu\u021biilor de personal. Odat\u0103 cu aceste modific\u0103ri ale Codului muncii:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Angajatorii moldoveni pot angaja legal lucr\u0103tori temporari prin AMT \u00eenregistrate<\/strong><\/li>\n\n\n\n<li><strong>Lucr\u0103torii beneficiaz\u0103 de protec\u021bie garantat\u0103<\/strong>, inclusiv salarii egale, condi\u021bii de munc\u0103 sigure \u0219i drepturi complete<\/li>\n\n\n\n<li><strong>Procesul de angajare este reglementat \u0219i transparent<\/strong>, reduc\u00e2nd riscurile \u0219i \u00eencuraj\u00e2nd respectarea legii<\/li>\n<\/ul>\n\n\n\n<p>Aceast\u0103 reform\u0103 este un avantaj major pentru companiile din Moldova care au nevoie de personal sezonier sau pe proiecte.<br><br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><strong>Ce includ modific\u0103rile<\/strong><\/strong><\/h2>\n\n\n\n<p>Legea introduce defini\u021bii formale:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Agent de munc\u0103 temporar\u0103 (AMT)<\/strong> \u2013 Persoan\u0103 juridic\u0103 sau fizic\u0103 cu activitate antreprenorial\u0103, care notific\u0103 Inspectoratul de Stat al Muncii \u0219i \u00eencheie contracte individuale de munc\u0103 cu lucr\u0103tori temporari pentru a-i plasa la utilizatori<br><\/li>\n\n\n\n<li><strong>Lucr\u0103tor temporar<\/strong> \u2013 Persoan\u0103 angajat\u0103 de un AMT \u0219i plasat\u0103 la un utilizator pentru a munci sub supravegherea acestuia<br><\/li>\n\n\n\n<li><strong>Utilizator<\/strong> \u2013 Compania sau entitatea final\u0103 unde lucreaz\u0103 efectiv lucr\u0103torul temporar<\/li>\n<\/ul>\n\n\n\n<p><br><br><\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img loading=\"lazy\" decoding=\"async\" width=\"1440\" height=\"1080\" src=\"https:\/\/ara.md\/wp-content\/uploads\/2025\/07\/DSC06842-1440x1080.jpg\" alt=\"\" class=\"wp-image-7225\" srcset=\"https:\/\/ara.md\/wp-content\/uploads\/2025\/07\/DSC06842-1440x1080.jpg 1440w, https:\/\/ara.md\/wp-content\/uploads\/2025\/07\/DSC06842-600x450.jpg 600w, https:\/\/ara.md\/wp-content\/uploads\/2025\/07\/DSC06842-768x576.jpg 768w, https:\/\/ara.md\/wp-content\/uploads\/2025\/07\/DSC06842.jpg 1500w\" sizes=\"auto, (max-width: 1440px) 100vw, 1440px\" \/><\/figure>\n\n\n\n<p><br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><strong>Prevederi \u0219i responsabilit\u0103\u021bi esen\u021biale<\/strong><\/strong><\/h2>\n\n\n\n<h4 class=\"wp-block-heading\"><strong><strong>1. Notificare obligatorie<\/strong><\/strong><\/h4>\n\n\n\n<p>AMT trebuie s\u0103 notifice <strong>Inspectoratul de Stat al Muncii<\/strong> cu 30 de zile \u00eenainte de a \u00eencepe activitatea. Func\u021bionarea f\u0103r\u0103 notificare este sanc\u021bionabil\u0103 conform Codului contraven\u021bional.<br><\/p>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>2. <strong>\u00a0Egalitate de tratament<\/strong><\/strong><\/h4>\n\n\n\n<p>Lucr\u0103torii temporari au dreptul la:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Acela\u0219i salariu ca angaja\u021bii direc\u021bi \u00een posturi similare<\/li>\n\n\n\n<li>Condi\u021bii de munc\u0103 egale, inclusiv program, repaus, concedii<\/li>\n\n\n\n<li>Acces la facilit\u0103\u021bi precum cantin\u0103, transport etc.<br><br><\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>3. <strong>Contracte clare \u0219i sigure<\/strong><\/strong><\/h4>\n\n\n\n<p>Fiecare misiune temporar\u0103 necesit\u0103:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Contract individual de munc\u0103 \u00eentre AMT \u0219i lucr\u0103tor<\/li>\n\n\n\n<li>Acord scris \u00eentre AMT \u0219i utilizator<\/li>\n\n\n\n<li>Prevederi clare privind riscurile la locul de munc\u0103, sarcini, termene de plat\u0103 \u0219i echipamente de protec\u021bie<br><br><\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>4. <strong>Limite privind durata misiunii<\/strong><\/strong><\/h4>\n\n\n\n<ul class=\"wp-block-list\">\n<li>O misiune poate dura p\u00e2n\u0103 la <strong>12 luni<\/strong>, cu posibilitate de prelungire p\u00e2n\u0103 la <strong>24 luni<\/strong><\/li>\n\n\n\n<li>Nu sunt permise mai mult de <strong>3 misiuni succesive<\/strong> pentru aceea\u0219i func\u021bie cu acela\u0219i lucr\u0103tor<br><br><\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\"><strong>5. <strong>Responsabilit\u0103\u021bi fiscale \u0219i sociale<\/strong><\/strong><\/h4>\n\n\n\n<p>AMT este responsabil pentru plata tuturor contribu\u021biilor sociale \u0219i a impozitelor aferente lucr\u0103torului. Dac\u0103 nu \u00ee\u0219i respect\u0103 obliga\u021biile, utilizatorul poate deveni co-responsabil.<br><br><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><strong>Apreciere pentru liderii reformei<\/strong><\/strong><\/h2>\n\n\n\n<p>Ne exprim\u0103m respectul \u0219i aprecierea pentru <strong>domnul Mihai-Gabriel Ciobanu<\/strong>, Secretar de stat \u00een cadrul <strong><a href=\"https:\/\/social.gov.md\/\">Ministerului Muncii \u0219i Protec\u021biei Sociale al Republicii Moldova<\/a><\/strong>, a c\u0103rui coordonare \u0219i implicare, al\u0103turi de echipa ministerului, au fost esen\u021biale \u00een realizarea acestor modific\u0103ri legislative.
