Recognizing the Leadership Behind the Reform

Congratulations, Moldova! As of July 2025, the Republic of Moldova has officially adopted important amendments to its Labour Code, introducing and regulating a new employment model: temporary work through temporary work agents (TWAs). These updates align Moldova’s labor legislation with European Union standards and provide a clear legal framework for domestic employers to engage temporary workers.

Not a New Law, But a Critical Reform

To clarify, this is not a standalone law but a set of modifications and additions to the Labour Code. For the first time, Moldova defines and regulates:

  • Temporary work agencies (TWAs)
  • Temporary workers
  • Users (employers) who utilize temporary labor through TWAs

The reforms align with EU Directive 2008/104/EC and other European labor and occupational safety directives.


Why It Matters – Especially for Moldovan Employers

Until now, Moldova lacked a legal framework for temporary staffing, which limited flexibility in labor solutions. With these Labour Code amendments:

  • Moldovan employers can now legally hire temporary workers via registered TWAs
  • Workers gain guaranteed protections, including equal pay, safe working conditions, and proper labor rights
  • The hiring process is regulated and transparent, reducing risks and promoting compliance

This reform is a major benefit for businesses in Moldova that require seasonal or project-based workforce flexibility.

What the Amendments Include

The law introduces formal definitions:

  • Temporary Work Agency (TWA) – A legal or physical person who engages in entrepreneurial activity, notifies the Labour Inspectorate, and signs employment contracts with temporary workers to assign them to user companies
  • Temporary Worker – A person employed by a TWA and assigned to a user to work under their supervision

User – The final company or entity where the temporary worker performs the job


Key Provisions and Responsibilities

1. Mandatory Notification

TWAs must notify the Labour Inspectorate 30 days before starting operations. Operating without notification is subject to sanctions under the Contraventional Code.

2. Equal Treatment

Temporary workers are entitled to:

  • The same salary as directly hired employees in similar roles
  • Equal working conditions, including working hours, rest periods, and leave
  • Access to company facilities such as canteens, transport, etc.

3. Clear and Safe Contracts

Each temporary assignment requires:

  • An individual employment contract between the TWA and the worker
  • A written agreement between the TWA and the user
  • Detailed provisions regarding job risks, duties, salary payment dates, and required protective equipment

4. Assignment Duration Limits

  • A mission can last up to 12 months, with a possible extension up to 24 months
  • No more than 3 consecutive assignments for the same position with the same worker

5. Tax and Social Security Responsibilities

The TWA is responsible for all social contributions and taxes on behalf of the worker. If the TWA fails, the user may be held jointly liable.
